Amicus Curiae Brief on the arbitral award rendered on 15 November 2016 by the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry in case Ant Yapi against LG Electronics Ukraine

The UAA working group prepared and on 26.10.2017 submitted to the High Specialized Court of Ukraine for Civil and Criminal Cases the Amicus Curiae Brief in respect of the Ant Yapi vs. LG Electronics Ukraine Case (АС № 271ут/2016).

It involves important questions of the waiver of right to object (including with respect to the existence or validity of the arbitration agreement and, accordingly, the arbitral tribunal’s jurisdiction) if respective objections were not timely raised during arbitral proceedings, as well as conclusion of arbitration agreement by an exchange of statements of claim and defence

The Amicus Curiae Brief analyses applicable provisions of Ukrainian law, available practice of Ukrainian courts, as well as foreign scholar writings and jurisprudence on these questions.
