Roundtable on improvement of Ukrainian legislation held

On 18 December 2012 the Ukrainian Arbitration Association (the Association) jointly with the representatives of ICC Ukraine, International Commercial Arbitration Court at the CCI of Ukraine and the Arbitration Chamber of Ukraine have held a roundtable where urgent measures for the improvement of Ukrainian arbitration legislation, including the promotion of the draft law prepared by a working group of the specialist committee of ICC Ukraine were discussed.

The event was attended by the president of the Association Tatyana Slipachuk, members of the Board of the Association Olena Perepelynska, Markiyan Malskyy, Tetiana Zakharchenko (Vice President of the MAC at the CCI of Ukraine), Anatoliy Zhukov (Vice Chairman of the Arbitration Chamber of Ukraine), Taras Shepel (Court Chairman at ICC Ukraine Arbitration Court), as well as members of the working group at the ICC Ukraine Yaroslav Petrov and Sergiy Gryshko.

During the roundtable the attendees discussed such matters as making amendments to the current Ukrainian alternative dispute resolution and arbitration legislation. The attendees confirmed that apart from the present gaps in the legislative regulation of a number of matters (arbitrability, application and types of interim measures in support of domestic arbitration and international arbitration, other measures by national courts in support of alternative dispute resolution and others) there is a whole range of issues in court practice whose resolution will promote the positive image of Ukraine as an arbitration-friendly jurisdiction.

It was agreed that a working group will be established to develop a draft law concerning amendments to a number of statutory instruments of Ukraine, as well as to issue a letter to the Higher Specialized Court of Ukraine concerning the shaping of arbitration-friendly court practice in cases relating to challenging and enforcement of domestic and international arbitral awards as well as support to domestic and international arbitral proceedings.

At the initiative of ICC Ukraine, on 28 December 2012, the representatives of the arbitration committee of ICC Ukraine have held an additional meeting with the president of the Association Tatyana Slipachuk where perspectives of cooperation were discussed.

Members of the Association can be an individual with a law degree, is a specialist in international commercial arbitration or have a professional interest in international commercial arbitration and share the goals and objectives of the Association. Read more
