Ukrainian Arbitration Association supported the translation of IBA Rules on the Taking of Evidence in International Arbitration

Ukrainian Arbitration Association (the “UAA”) supported the translation into Ukrainian of the IBA Rules on the Taking of Evidence in International Arbitration (the “Rules”), adopted by IBA Council Resolution on May 29, 2010.

In every arbitration a key issue the parties and their counsel – as well as the arbitral tribunal- must face is the determination of the procedures for that arbitration. As a rule, neither domestic arbitration legislation, nor arbitration rules provide for detailed regulation of procedure for gathering and presenting of evidence.

To help the parties, counsel and arbitrators to determine appropriate evidence-taking procedure, the IBA adopted the Rules that ensure a unique balance between the evidence-taking peculiarities inherent to systems of civil law and common law. The most reputable international surveys unanimously recognize the Rules as the most reliable, effective and widely employed instrument governing the procedure of taking of evidence in international arbitration.

The Task Force working on the translation of the Rules into Ukrainian included UAA members Ihor Siusel (Baker & McKenzie) and Olga Vorozhbyt (CMS Cameron McKenna), UAA Secretary General & Board Member Yaroslav Petrov (Asters) and UAA Board Member coordinating the work of the Task Force - Olena Perepelynska (Integrites).
