UAA submitted its comments on Draft Laws №7520, №7520-1 and №7520-2
On September 8, 2022 Ukrainian Arbitration Association submitted its comments on Draft Laws №7520, №7520-1 and №7520-2 to the Verkhovna Rada of Ukraine.
In July 2022, the Verkhovna Rada of Ukraine registered three drft laws No. 7520, No. 7520-1, No. 7520-2, which relate to various aspects of consideration of court cases in connection with the armed aggression of the Russian Federation (“Draft Laws”).
In particular, the draft laws regulate the issue of (I) the jurisdictional immunity of the Russian Federation, (II) the procedure for notifying it as a defendant in the case and submitting the court documents, (ІІІ) regarding regulation of the range of possible subjects of civil liability, (IV) regarding civil legal liability of "persons associated with the Russian Federation", (V) jurisdiction and delimitation of the jurisdiction of general and commercial courts.
Many of these issues have an international legal component and can potentially have consequences for legal proceedings in other jurisdictions, in particular, regarding the execution of court decisions, or, unfortunately, become a potential basis for claims against Ukraine in the order of international investment arbitration. And since UAA members have a lot of experience in these issues, because they also regularly arise in the context of arbitration and court cases regarding the enforcement of arbitration decisions, UAA created a Working Group of Ukrainian and foreign experts, which analyzed the changes proposed by the Draft Laws and the possible consequences of their acceptance.
According to the results of the analysis and discussion, on September 8, 2022, the UAA submitted its comments on Draft Laws No. 7520, No. 7520-1, No. 7520-2 to the Verkhovna Rada of Ukraine.
